Email: info@maxpixart.com
By purchasing an artwork or commissioning a custom piece, the customer agrees to these Terms & Conditions.
2. Artworks and Availability
All artworks offered by Max&Pix art are original handmade works.
Due to the nature of wood, hand-finishing, painting and the wooden pixel technique, minor variations and natural irregularities are part of the character of each artwork and are not considered defects.
Availability of individual artworks is confirmed upon inquiry.
Unless expressly stated otherwise, each artwork is offered as a unique original and is not reproduced as an identical copy.
3. Prices
Each artwork is individually priced.
Current prices and availability are provided upon request.
Unless otherwise agreed, the quoted artwork price includes the standard Max&Pix art frame.
Custom framing, special materials, third-party framing or other requested modifications may result in an additional charge.
Shipping, insurance, customs duties, import taxes and other destination-related costs are not included unless expressly stated otherwise in the quotation.
4. Orders and Formation of Contract
Submitting an inquiry through the website does not create a binding purchase contract.
A purchase becomes binding once the customer and Max&Pix art have agreed on:
- the artwork or commission,
- the final price,
- payment conditions,
- delivery arrangements,
- and any other relevant specifications,
and the order has been confirmed by Max&Pix art.
The confirmation may be made by email or another agreed written form.
5. Payment
Payment conditions are communicated individually before the purchase is confirmed.
Unless otherwise agreed, the artwork must be paid in full before dispatch.
For commissioned or custom-made artworks, a deposit may be required before work begins.
The amount of the deposit, payment schedule and whether the deposit is refundable will be communicated and agreed before the commission is accepted.
6. Commissioned and Custom-Made Artworks
Custom artworks are created according to specifications agreed individually with the customer.
The final appearance may include minor artistic variations resulting from the handmade process, materials and artistic interpretation.
Where an artwork is made specifically according to the customer’s individual requirements or is clearly personalised, the statutory right to withdraw from the contract may not apply in accordance with applicable consumer law.
Any specific cancellation conditions for commissioned work will be communicated before the commission is confirmed.
7. Shipping and Delivery
Each artwork is carefully packed for transport.
Shipping costs are calculated individually according to the artwork’s dimensions, weight, value and destination.
Where appropriate, delivery may be arranged through specialised or insured art transportation services.
Estimated delivery dates are provided in good faith but may be affected by circumstances outside the artist’s control, including courier delays, customs procedures or international transport conditions.
For international deliveries, the customer is responsible for any customs duties, import taxes or similar charges imposed in the destination country unless otherwise agreed.
8. Inspection Upon Delivery
Customers are encouraged to inspect the package and artwork promptly upon delivery.
If the packaging or artwork appears damaged during transport, the customer should:
- photograph the packaging before opening where possible,
- photograph any visible damage,
- retain all packaging materials,
- and contact Max&Pix art as soon as possible at info@maxpixart.com.
These steps help us submit and resolve any transport insurance claim.
Nothing in this section limits the customer’s statutory consumer rights.
9. Right of Withdrawal
Where the customer is a consumer and the purchase is concluded at a distance, the customer may have the statutory right to withdraw from the contract within the period provided by applicable law.
Under Slovak consumer law, this period is generally 14 days for eligible distance purchases.
The right of withdrawal may not apply in circumstances provided by law, including certain goods made according to the customer’s specifications or clearly personalised for the customer.
To exercise the right of withdrawal, please contact:
Where applicable, the customer is responsible for returning the artwork safely and in appropriate packaging, subject to mandatory consumer protection rules.
10. Returns
Returned artworks must be handled and packaged with appropriate care.
The customer may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the artwork, as permitted by applicable law.
Return shipping arrangements and costs will be handled according to applicable consumer law and the circumstances of the purchase.
11. Complaints and Defects
If an artwork has a defect or does not correspond to the agreed purchase, please contact info@maxpixart.com with a description and photographs where appropriate.
Claims will be handled in accordance with applicable Slovak and European consumer protection law.
Natural characteristics of wood, handmade variations, minor differences in colour caused by screens or lighting, and characteristics intentionally resulting from the artistic technique are not in themselves considered defects.
12. Certificate of Authenticity
Unless otherwise stated, each original artwork is supplied with a signed Certificate of Authenticity.
The certificate forms part of the provenance of the artwork and should be retained by the collector.
13. Intellectual Property and Copyright
The purchase of an artwork transfers ownership of the physical artwork only.
Copyright and all other intellectual property rights in the artwork remain with the artist unless expressly agreed otherwise in writing.
The buyer may display and resell the physical artwork but may not reproduce, commercially exploit, manufacture copies of, license, or otherwise use the artwork for commercial purposes without prior written permission from the artist.
Max&Pix art may use photographs and reproductions of sold artworks for portfolio, archival, publication, exhibition and promotional purposes unless otherwise agreed.
14. Website Images and Colour Representation
We make reasonable efforts to represent artworks accurately on the website.
However, colours, metallic finishes, textures, depth and reflections may appear differently depending on lighting, photography, display settings and the viewer’s device.
Such differences are inherent in viewing physical artwork digitally and do not necessarily constitute a defect.
15. Liability
Nothing in these Terms excludes or restricts any liability that cannot legally be excluded under applicable law.
To the extent permitted by law, Max&Pix art is not responsible for indirect losses arising from circumstances beyond reasonable control.
16. Personal Data
Personal data is processed in accordance with our Privacy Policy.
Information about cookies and tracking technologies is available in our Cookie Policy and Cookie Settings.
17. Consumer Dispute Resolution
If a consumer is dissatisfied with the handling of a complaint or believes that consumer rights have been infringed, the consumer may seek alternative dispute resolution where the statutory conditions are met.
In Slovakia, information on alternative consumer dispute resolution is available through the Slovak Trade Inspection and other authorised ADR entities.
18. Governing Law
These Terms & Conditions are governed by the laws of the Slovak Republic.
Where the customer is a consumer residing in another country, this does not deprive the customer of any mandatory consumer protections applicable under the law of their country of residence.
19. Changes to These Terms
These Terms & Conditions may be updated from time to time.
The version applicable to a particular purchase is the version in force at the time the purchase agreement is concluded.
